1. Acceptance of Terms
By accessing and using the services of SimplyWell Private Practice (“SWPP”, “we”, “us”, “our”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
2. Services
2.1 We provide virtual psychotherapy and related psychological services to clients worldwide.
2.2 All services are delivered by appropriately qualified professionals, in line with applicable laws, regulatory requirements, and professional ethical codes.
2.3 Services are not a substitute for emergency or acute psychiatric care.
3. Therapeutic Approach
We utilise evidence-based and integrative therapeutic modalities, tailored to each client’s needs and clinical presentation. The therapeutic process is collaborative and may evolve over time in response to your goals, circumstances, and progress.
4. Client Responsibilities
Clients are expected to:
4.1 Attend sessions punctually and in a suitable, private environment for online therapy.
4.2 Engage actively and honestly in the therapeutic process.
4.3 Adhere, as reasonably as possible, to agreed treatment plans and therapeutic goals.
4.4 Inform us of any significant changes in mental or physical health, medication, or risk-related concerns.
5. Appointments and Cancellations
5.1 Scheduling: Appointments are scheduled in advance. Clients may request preferred times, which will be accommodated where possible. Regular, consistent appointment times are encouraged to support continuity of care.
5.2 Cancellation Policy:
5.2.1 A minimum of 24 hours’ notice is required to cancel or reschedule an appointment without incurring a cancellation fee.
5.2.2 Cancellations made with less than 24 hours’ notice, and missed appointments (“no-shows”), may be charged at the full session fee, as this time is reserved exclusively for you.
5.3 Grace Period:
For virtual appointments, there is a 10-minute grace period. If a client has not joined the session within 10 minutes of the scheduled start time, the session may be deemed a no-show and treated in accordance with clause 5.2.2.
5.4 How to Cancel or Reschedule: To cancel or reschedule an appointment, please contact the practice assistant by email at carrie@simplywellpsychology.com (or via any alternative contact method expressly provided to you in writing).
6. Fees and Payment
6.1 Fees
Session fees and any applicable charges for additional services (such as group therapy, workshops, or reports) will be communicated to you in writing prior to commencement of services and/or published on our official channels.
6.2 Payment Terms
6.2.1 Unless otherwise agreed in writing, payment must be made in advance of sessions, within the timeframe specified in your booking confirmation or invoice, in order to secure your appointment.
6.2.2 Accepted payment methods will be specified in your onboarding information or invoice (for example: secure payment platforms, bank transfer, or other approved methods).
6.3 Changes to Fees
We reserve the right to review and adjust our fees from time to time. Any change in fees will be communicated to you in advance and will not be applied retrospectively to sessions already paid for.
7. Confidentiality
7.1 We are committed to maintaining your confidentiality in accordance with professional codes of ethics, UK law, and data protection regulations. Information shared in therapy is treated as confidential.
7.2 Confidentiality may, however, be breached without your consent where:
7.2.1 There is a serious and imminent risk of harm to you or to others.
7.2.2 We are required to disclose information by law, court order, or a regulatory authority.
7.2.3 There are safeguarding concerns involving children or vulnerable adults.
7.3 Where reasonably possible, and where it does not increase risk or contravene legal obligations, we will seek to discuss any potential breach of confidentiality with you before acting.
8. Use of Website
8.1 Informational Content
The content on our website and related online materials is provided for general information only. It does not constitute medical, psychological, legal, or financial advice and should not be relied upon as such.
8.2 No Professional Client Relationship via Website
Accessing or reading information on our website does not in itself create a therapist–client relationship. That relationship is established only when you have been formally accepted as a client and have attended a booked session.
8.3 Third-Party Links
Where our website or communications may occasionally reference external resources, we do not endorse and are not responsible or liable for the content, accuracy, or practices of any third-party sites or services.
Emergency and Crisis Situations
9.1 SWPP is not a crisis or emergency service.
9.2 If you are in immediate danger or experiencing a mental health crisis, you must contact local emergency services, crisis lines, or attend the nearest emergency department.
9.3 Therapy sessions with SWPP are not designed to provide real-time emergency intervention or constant availability between sessions.
10. Termination of Services
Ending therapy is an important part of the therapeutic process and is ideally approached collaboratively and thoughtfully.
10.1 Client-Initiated Termination
10.1.1 You may choose to end therapy at any time.
10.1.2 You are encouraged, where possible, to give at least one session’s notice and to attend a final session to review progress, reflect on the work completed, and discuss strategies for maintaining your well-being.
10.2 Therapist-Initiated Termination
10.2.1 We may propose ending or pausing therapy where it is clinically or ethically indicated (for example, if therapy is no longer beneficial, if there is a conflict of interest, persistent non-attendance, or if your needs would be better met by a different service).
10.2.2 Where practicable, you will be given reasonable notice (typically at least two sessions) and, where appropriate, we will assist you in identifying alternative support or referral options.
10.3 Mutual Agreement
10.3.1 Therapy may also conclude by mutual agreement when therapeutic goals have been sufficiently met or when both parties consider that the work has reached a natural point of completion.
10.4 Practical Considerations
10.4.1 Any outstanding invoices should be settled before the final session, unless otherwise agreed in writing.
10.4.2 Any unused prepaid sessions will be handled in accordance with our refund and cancellation policies, which will be shared with you in writing where relevant.
10.4.3 Clinical records will be retained and stored securely for the period required by UK law, professional guidelines, and GDPR, after which they will be safely destroyed.
11. Data Protection and Privacy
11.1 We process personal data in accordance with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
11.2 Details regarding how we collect, store, use, and protect your data, and your rights as a data subject, are set out in our Privacy Policy, which forms part of these Terms of Service.
12. Limitation of Liability
12.1 To the fullest extent permitted by law, SWPP and its practitioners shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of, or in connection with, the use of our services or website.
12.2 Nothing in these Terms seeks to exclude or limit liability for:
12.2.1 Death or personal injury caused by negligence;
12.2.2 Fraud or fraudulent misrepresentation; or
12.2.3 Any other liability that cannot lawfully be excluded or limited.
13. Governing Law and Jurisdiction
These Terms of Service and any non-contractual obligations arising out of or in connection with them are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to resolve any disputes arising from or relating to these Terms or the provision of our services.
14. Changes to These Terms
We may update or amend these Terms of Service from time to time to reflect legal, regulatory, or operational changes. The most current version will be posted on our website with the effective date. Continued use of our services after such changes take effect constitutes your acceptance of the updated Terms.
